國際法的法律位階 Rankings of the International Laws

國際法中的自然法（The Natural Law）、萬國公法（Law of Nations）、國際條約（International Treaty）、甚至美國憲法（US Constitution），當然也包含二戰後的舊金山和平條約（San Francisco Peace Treaty），就這些國際法中的法律位階而言，可以整理出下列規則：

1. The Natural Law (The Law of God) : the supreme law of the universe

    自然法（神的律法）                        :   宇宙的最高法律

2.The Law of Nations : the supreme law of the world

      萬國公法              :   世界最高法律

3. The Constitution, International Treaties: the supreme law of the land

     憲法，國際條約                                  ：國家的最高法律

在「不可逆行(irreversible)」之法律體制內，位階較低法，不得抵觸位階較高法，這是屬於通則。反之，位階較高法，無需屈就位階較低法，這也是通則。美國憲法和包括舊金山和平條約，這些所有由美國政府擬訂之國際條約，是不能也不可違反萬國公法。So, make no mistake(所以，別搞錯了)，是故，舊金山和平條約不得違反萬國公法，非萬國公法不得違反舊金山和平條約，法理立場並無本末倒置空間。
